The Service allows users to access and use a variety of educational services, including learning or practicing subjects and courses. Kiwilex may, in its sole discretion and at any time, update, change, suspend, make improvements to or discontinue any aspect of the Service, temporarily or permanently.
When you use Kiwilex you provide us with two types of information: (i) information you submit via the Service and (ii) information regarding your use of the Service collected by us as you interact with the Service.
When you enter the Website, we collect your browser type and your IP address (a unique address that identifies your computer on the Internet). When you use our mobile Application, we collect your device type, your device ID, and your IP address. In addition, we store certain information from your browser using "cookies." A cookie is a piece of data stored on the user's computer tied to information about the user. We use session ID cookies to confirm that users are logged in. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to deny or accept the cookie feature; however, you should note that cookies may be necessary to provide you certain features available on the Website (e.g., customized delivery of information).
Through the registration process you may provide us with your name and email address, hometown, and other information that may be requested during the registration process. If you register for the Kiwilex Aplication, each time you take a test you must also provide a picture or scan of a current, valid driver's license, passport or other government issued ID and a picture of your face (a "Testing ID"). Your Testing ID will be stored for ninety (90) days after validation to help resolve any disputes.
When you use the Service you may submit information and content to your profile, generate Activity Data through engaging in educational activities on the Service, or send messages and otherwise transmit information to other users. We store this information so that we can provide you the Service and offer personalized features.
While using the Kiwilex Aplication you will submit answers to questions and other information as part of the testing and evaluation process. We will store that information and use it to evaluate your performance on the test, to report results and to evaluate the usefulness, accuracy and other aspects of the Kiwilex Aplication.
We do not share your personal information with third-parties unless it is necessary to offer the Service or required by law.
4. USE OF INFORMATION OBTAINED BY KIWILEX
We may use your contact information to send you notifications regarding new services offered by Kiwilex that we think you may find valuable. Kiwilex may also send you service-related announcements from time to time through the general operation of the Service. Generally, you may opt out of such emails.
Profile information is used by Kiwilex to be presented back to and edited by you when you access the Service and to be presented to other users. In some cases, other users may be able to supplement your profile, including by submitting comments (which can be deleted by you).
Kiwilex may use or share aggregate or anonymous data collected through the Service, including Activity Data, for purposes such as understanding or improving the service.
5. USER-GENERATED CONTENT
Kiwilex S.A.C. (“Kiwilex”) owns and/or operates various websites, social media, and other online properties that permit users to submit or publish content (“User-Generated Websites”). Such websites may include but are not limited to, message boards, blogs, social networks, and comment boards. By registering or using any User-Generated Websites, you accept and agree to the following Terms and conditions for User-Generated Content.
Abbreviated Terms Community Guidelines: Our application is a family-friendly page. We ask that you play nice and be
polite. While we encourage the sharing of your comments, photos, and links, please understand that the postings to
our page do not necessarily represent the opinions of Kiwilex S.A.C. or its affiliates. Posts that we feel are offensive,
inappropriate or not otherwise keeping with the spirit of the page, such as advertising, spam, posts that reflect
irresponsible pet ownership, are off-topic, or contain vulgar language, posts that may violate the rights of
others, or violate any of Kiwilex’s terms of use, or may be removed. We also reserve the right to block. If
you have a material connection to Kiwilex (as an employee, agency, sponsored blogger/brand ambassador, etc.), please
be sure to let everyone know that when you post.
Use of your comments, photos: By submitting or uploading your comment, photo of questions (“Your Content”)
on our wall or page, you are authorizing Kiwilex S.A.C. (Kiwilex) to use, publish, and otherwise reproduce,
modify and distribute Your Content with or without your name or the name. These uses may include but are not limited
to, information, education, promotion, or advertising of Kiwilex or its products via the Internet, websites, mobile
apps, and social media.
Social sharing and Kiwilex profile: You should not put sensitive information or other information you would not want made public, in your Profile or otherwise share that information socially. If you do include such information in your Profile or otherwise publicly share your information, then you agree that it is at your own risk and recognize that we cannot control third parties’ access to such information. You should not socially share or otherwise provide any of the following information or data in your Profile: (i) racial or ethnic origin, (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union or political party (v) physical or mental health or biometric or genetic details (vi) addictions, sexual activities (vii) criminal offences or proceedings (viii) information relating to unlawful or objectionable conduct, or (ix) any Social Security Number or national identification number.

Subscriptions on Kiwilex will automatically renew at the end of each contracted period and will be periodically charged to your registered account. If you wish to cancel or modify your subscription, you must log in to your Kiwilex account and follow the indicated steps to manage your subscription. This process is mandatory even if you have deleted your account to ensure that no future charges are made.
On Kiwilex, you can purchase, with real money, a limited, personal, and non-transferable license to use:
- Virtual currency, such as points, credits, or lives, for exclusive use within our services.
- Virtual items designed to enhance your experience in the app.
These items can only be purchased through Kiwilex. We reserve the right to modify, update prices, or remove virtual items at any time without prior notice. Transferring, selling, or exchanging these items is not allowed unless explicitly authorized by the service.
By using Kiwilex, you agree to pay all applicable fees and taxes incurred by you or anyone using an account registered in your name. We reserve the right to adjust the prices of goods and services offered through Kiwilex at any time. It is your responsibility to provide accurate, complete, and up-to-date information when making purchases or transactions on the service. You must also cover all charges resulting from the use of your credit card, debit card, or any other linked payment method, according to the prevailing prices at the time of the transaction. Additionally, you will be responsible for any applicable taxes related to such operations.
7. REFUND POLICIES
All payments are nonrefundable. There are no refunds or credits for Virtual Items or partially used membership periods. However, Kiwilex may grant refunds or credits on a case-by-case basis at our sole discretion or as a response and review through our Complaints Book. Kiwilex’s grant of a refund or credit in one instance does not obligate Kiwilex to provide a refund or credit in the future, under any circumstances. If you cancel your periodic subscription to a paid Kiwilex service, you will continue to have access to the service through the end of your current billing period.
8. PRIVACY
Use of the Service is also governed by our Privacy Policy, a copy of which is located at www.kiwilex.com/privacy . By using the Service, you consent to the terms of the Privacy Policy.
THE SERVICE, IS PROVIDED “AS IS,” WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND.
9. DELETED DATA
In all of our applications, we give you the option to delete data. The deleted data is kept in the database for up 30 days. After that, the data is purged and permanently deleted.
